HabitTracker is a mobile application designed to help users build better habits through focused, single-habit tracking. The App provides:

• Streak tracking and milestone celebrations
• Smart reminders and notifications
• Analytics and insights (Premium feature)
• AI-powered coaching tips (Premium feature)
• Data synchronization via iCloud

The App is based on behavioral science research and is designed to maximize habit formation success through focused attention on one habit at a time.

3. Account Registration

To use HabitTracker, you must:

• Be at least 13 years of age
• Have a valid Apple ID
• Provide accurate and complete information
• Maintain the security of your account credentials

You are responsible for all activities that occur under your account. If you suspect unauthorized use of your account, please contact us immediately.

4. Privacy and Data Collection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

HabitTracker Premium is available as:

• Monthly subscription: $1.99/month
• Annual subscription: $19.99/year

• Milestone graduation ceremonies
• Risk analysis for streak protection

7.3 Payment Terms

• All payments are processed through Apple's App Store
• Subscriptions automatically renew unless cancelled
• You can cancel anytime through your Apple ID settings
• No refunds for partial subscription periods

8. Intellectual Property

The App and its original content, features, and functionality are owned by HabitTracker and are protected by international copyright, trademark, and other intellectual property laws.

You may not:

• Copy, modify, or distribute the App
• Reverse engineer or attempt to extract source code
• Use our trademarks without permission
• Remove any proprietary notices

9. Termination

We reserve the right to terminate or suspend your access to the App immediately, without prior notice, for any reason, including:

• Violation of these Terms
• Fraudulent or illegal activity
• Request by law enforcement
• Extended periods of inactivity

Upon termination, your right to use the App will cease immediately. You may delete your account at any time through the App's settings.

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

We do not warrant that:

• The App will be uninterrupted or error-free
• The App will meet your specific requirements
• The results obtained from using the App will be accurate or reliable

HabitTracker is not a medical app and should not be used as a substitute for professional medical advice, diagnosis, or treatment.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HABITTRACKER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

Our total liability for any claim arising out of or relating to these Terms or the App shall not exceed the amount you paid us in the 12 months prior to the claim.

12. Indemnification

You agree to indemnify and hold harmless HabitTracker, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another party

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by:

• Posting the new Terms in the App
• Updating the "Effective Date" at the top
• Sending a notification through the App

Your continued use of the App after changes constitutes acceptance of the new Terms.
