Please read these Terms of Service ("Terms") carefully before using Color ("the App"). By using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

We reserve the right to modify these Terms at any time. Continued use after changes constitutes acceptance of the modified Terms.

2. Service Description

Color is an iOS application designed to help users capture colors from the real world and photos, build harmonious color palettes, and export them for creative projects. The App provides:

• Camera-based color capture with instant color identification
• Photo color extraction from your photo library
• Color palette generation using color theory harmonies
• AI-powered palette generation from text descriptions

3. Accounts & Authentication

To use the App, you must sign in with your Apple ID using Sign in with Apple. You are responsible for:

• Maintaining the security of your Apple ID
• All activities that occur under your account
• Notifying us of any unauthorized use

4. Subscriptions & Payments

Free Tier

The free tier includes limited daily captures (3 camera, 3 photo), and up to 5 saved palettes.

Premium Subscription

Premium subscribers get unlimited captures, AI palette generation, advanced export options (Procreate, Adobe, SVG), and accessibility features including contrast checker and color blindness simulation.

Billing

• Subscriptions are billed through your Apple ID
• Subscriptions auto-renew unless canceled at least 24 hours before the end of the current period
• You can manage subscriptions in your Apple ID settings

Refunds

Refunds are handled by Apple according to their refund policies. Contact Apple Support for refund requests.

5. Your Content

You retain ownership of all content you create in the App, including:

• Saved colors and their custom names
• Color palettes you create
• Any personal notes or data you input

By using the App, you grant us a limited license to process your content as needed to provide our services.

6. AI-Generated Content

Nature of AI Responses

AI-generated content is:

• Generated by artificial intelligence, not a real person
• Processed entirely on your device for privacy
• For creative inspiration and starting points
• Not guaranteed to match exact expectations

On-Device Processing

The AI palette generator uses Apple's Foundation Models which run entirely on your device. Your prompts and generated palettes are not sent to external servers.

7. Acceptable Use

You agree not to use the App to:

• Attempt to circumvent usage limits or security measures
• Use the service for purposes it was not designed for
• Reverse engineer, decompile, or disassemble the App
• Use the App for any illegal purpose

8. Intellectual Property

The App, including its design, features, and code, is owned by Spaghetti Coder Apps and protected by intellectual property laws.

Color names and Pantone/RAL references are provided for informational purposes. Pantone and RAL are trademarks of their respective owners.

9. Disclaimers

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT

We do not warrant that the App will be uninterrupted, error-free, or secure.

Color accuracy may vary depending on your device's camera, display calibration, and lighting conditions. Colors captured should be verified against physical samples for critical applications.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, or consequential damages
• Loss of data or business opportunities
• Any damages exceeding the amount you paid us in the past 12 months

11. Termination

We may terminate or suspend your access to the App at any time for violation of these Terms or for any other reason.

Upon termination:

• Your right to use the App ceases immediately
• Your local data remains on your device unless you delete the app
• You may delete your account and server data from Settings before termination
