Agreement to Terms

By downloading, installing, or using the HydroHero mobile application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

Description of Service

HydroHero is a hydration tracking application that helps users monitor their water and beverage intake. The App includes features such as:

• Water and beverage intake logging
• Motion detection and shake-to-log functionality
• Daily hydration goals and progress tracking
• Gamification features (levels, quests, rewards)
• Smart reminders and notifications
• CloudKit sync across Apple devices
• HealthKit integration
• Analytics and insights (Premium)
• Data export capabilities

Use License

We grant you a personal, non-transferable, non-exclusive license to use the App for your personal hydration tracking purposes. You may not:

• Modify, reverse engineer, or decompile the App
• Remove any copyright or proprietary notices
• Transfer or sublicense your rights to use the App
• Use the App for any commercial purposes
• Attempt to gain unauthorized access to the App's systems
• Use automated systems to access the App

Premium Subscription

Subscription Terms

HydroHero offers a premium subscription with additional features:

• All liquid types (coffee, tea, juice, etc.)
• 2x XP earning rate
• All 4 daily quests unlocked
• All premium themes
• Advanced analytics and insights
• Unlimited history access
• Data export in CSV/JSON formats

Billing

• Subscriptions are billed through Apple's App Store
• Payment will be charged to your Apple ID account
• Subscriptions auto-renew unless cancelled 24 hours before renewal
• You can manage subscriptions in Apple App Store settings
• No refunds for partial subscription periods

Free Trial

If you activate a free trial:

• The trial period will be clearly stated in the App
• Your subscription will begin when the trial ends
• You can cancel before the trial ends to avoid charges
• Only one free trial per user

User Responsibilities

You agree to:

• Provide accurate hydration data for personal tracking
• Use the App in compliance with all applicable laws
• Not share your Apple ID or account credentials
• Maintain the security of your device
• Not attempt to harm or disrupt the App's functionality
• Use motion detection features safely and responsibly

Motion Detection and Safety

When using shake-to-log features:

• Always use motion detection in safe environments
• Do not shake your device while driving or operating machinery
• Be aware of your surroundings when using motion features
• The App is not responsible for injuries from improper use
• Motion detection accuracy may vary by device and conditions

Data and Privacy

Your use of the App is also governed by our Privacy Policy. By using the App, you consent to:

• Collection and processing of hydration data
• CloudKit sync across your Apple devices
• Anonymous analytics for app improvement
• HealthKit integration (if you grant permission)

CloudKit and Data Sync

Regarding data synchronization:

• CloudKit sync requires an active internet connection
• We are not responsible for sync failures due to Apple services
• Data conflicts are resolved using timestamps
• You control your CloudKit data through your Apple ID

Limitation of Liability

To the fullest extent permitted by law:

• The App is provided "as is" without warranties
• We are not liable for any damages from use or inability to use the App
• We are not responsible for data loss or corruption
• Maximum liability is limited to subscription fees paid
• We are not liable for health outcomes based on App usage

Intellectual Property

All content, features, and functionality of the App are owned by us and protected by copyright, trademark, and other intellectual property laws. The HydroHero name, logo, and design are our trademarks.

Termination

We may terminate or suspend your access to the App:

• For violation of these Terms
• For fraudulent or illegal activity
• At our discretion with notice
• You may terminate by deleting the App

Updates and Changes

We reserve the right to:

• Update the App with new features or improvements
• Modify or discontinue features
• Change subscription pricing with notice
• Update these Terms (effective upon posting)

Governing Law

These Terms are governed by the laws of the United States and the State of California, without regard to conflict of law provisions.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and HydroHero regarding use of the App.
